Mahua Moitra made MP, is there any way left to return to Parliament again? Know the options

Mahua Moitra: Trinamool Congress MP Mahua Moitra was expelled from the membership of the House on Friday (December 8) in the ‘cash for query’ case. The Ethics Committee of Parliament had recommended the expulsion of Mahua in this matter. Parliamentary Affairs Minister Prahlad Joshi presented the expulsion motion, which was approved by voice vote. At the same time, the opposition has compared Mahua’s resignation as MP to the murder of democracy. Mahua has also declared herself innocent.

Actually, Mahua Moitra was accused of sharing her Parliament login ID password with businessman Darshan Hiranandani. He was also accused of asking 61 questions about his ID between 2019-23, which were not asked by Mahua but by Hiranandani. In return, Hiranandani provided cash, gifts and many other types of help to Mahua. BJP MP Nishikant Dubey had complained about this matter, after which the Ethics Committee started investigation.

What did Mahua say?

At the same time, after leaving the MP, Mahua said that the decision to expel him is like a death sentence given through ‘Kangaroo Court’. He alleged that the government has started making the Ethics Committee a weapon to subdue the opposition. Mahua said that he has been found guilty of a code of conduct which does not exist. There is no evidence of cash or gifts. In such a situation, the question now arises that what options are left for Mahua after the departure of the MP.

What options are left for Mahua?

Actually, Mahua Moitra has a total of five options left. But right now it cannot be said clearly that if she uses these options, she will get relief. In such a situation, let us know about these five options.

  • The first option the TMC leader has is to request Parliament to review the decision. However, the final decision will be taken by the MP whether he wants to consider it or not.
  • Mahua Moitra has another option to go to the Supreme Court citing violation of fundamental rights and natural justice. He should file a case in this matter and then expect the court’s decision.
  • Mahua has the third option to accept the decision of the Parliament and move ahead. Elections are going to be held once again after about four months. He should contest the elections and after winning it, he should again enter the Parliament.
  • If TMC leaders wish, they can challenge the jurisdiction of the Ethics Committee as a fourth option. She can argue that the Ethics Committee was biased and gave the decision against her. She can also say that this matter should be looked into by the Privileges Committee.
  • As a fifth option, Mahua Moitra can seek relief through the ongoing case in Delhi High Court. For this, he will have to prove in the court that his image has been tarnished by the allegations leveled against him. Through this she can hope to change the decision of the Ethics Committee.
